Attain Construction Services – Terms of Service

  1. Introduction & Agreement

Welcome to Attain Construction Services LLC (“Company,” “we,” “us,” or “our”). By accessing our website, attaintoday.com, or using our services, you (“Client,” “you,” or “your”) agree to these Terms of Service (“Terms”). These Terms govern all transactions, agreements, and interactions with Attain Construction Services.

Attain Construction Services provides professional construction and maintenance services, including but not limited to:

  • Demolition & waste removal
  • Power washing

Service Eligibility:

  • Clients must be 18 years or older or have legal authority to enter a service agreement.
  • Clients are responsible for securing necessary permits and regulatory approvals for their projects.
  • We reserve the right to refuse service for reasons including project feasibility, safety concerns, or legal restrictions.
  1. Client Responsibilities

By engaging our services, you agree to:

  • Provide accurate project details to ensure proper estimates.
  • Ensure safe and unobstructed job site access during scheduled service times.
  • Adhere to payment terms as outlined in Section 4.
  • Comply with all applicable laws, regulations, and ordinances related to construction and property use.
  • Promptly communicate any scheduling changes that may affect service delivery.

Failure to meet these responsibilities may result in service delays, additional costs, project cancellation, or forfeiture of deposits.

  1. Estimates, Payments & Refunds

Estimates

  • Initial estimates are non-binding and subject to adjustment based on material costs or unforeseen conditions.
  • Final pricing will be confirmed in writing before service commencement.
  • Estimates are valid for 30 days, unless otherwise stated.

Payments

  • A deposit or partial payment is required before service begins.
  • Full payment is due within 30 calendar days of service completion unless stated otherwise.
  • Accepted payment methods: Credit/Debit Cards, Bank Transfers, or other approved methods.
  • Late payments incur a 1.5% monthly late fee or the maximum rate permitted by law.

Refunds & Cancellations

  • Cancellations at least 7 days before work begins may qualify for a partial refund, minus material and prep costs.
  • Cancellations after work starts are reviewed case-by-case, but refunds are not guaranteed.
  • Deposits for large-scale projects are non-refundable once materials are purchased.
  • If we cancel services due to unforeseen circumstances, reasonable notice will be given, and refunds may be issued where appropriate.

How We Use Your Data

We collect personal information such as name, contact details, and payment information to:

  • Schedule and manage services.

  • We are not liable for damages caused by third-party contractors or undisclosed pre-existing conditions.

Worksite Safety

  • Clients must maintain safe working conditions. Hazardous environments may result in project cancellation or additional fees.
  • We are not responsible for injuries or damages caused by unsafe job sites.

  Warranty Policy

  • Certain services may include a limited workmanship warranty, outlined in your service contract.
  • Warranties do not cover normal wear and tear, misuse, or third-party damage.
  • Warranty claims must be submitted in writing within the warranty period.

Limitation of Liability

Attain Construction Services shall not be liable for indirect, incidental, or punitive damages, including lost profits or data. Total liability is limited to the amount paid by the client for the specific service in question.

  1. Dispute Resolution & Legal Terms

Governing Law

These Terms are governed by Virginia state law, without regard to conflict of law principles.

Dispute Resolution

If a dispute arises:

  1. Informal Negotiation – You must contact info@attaintoday.com to seek resolution within 30 days.
  2. Mediation – If unresolved, disputes shall proceed to mediation in Fairfax County, Virginia, with costs shared equally.
  3. Binding Arbitration – If mediation fails, disputes shall be resolved through binding arbitration, conducted in Fairfax County under AAA arbitration rules.

Class Action Waiver

You agree that disputes must be handled individually and waive participation in class actions against Attain Construction Services.

  1. Modifications & Updates

We reserve the right to modify these Terms at any time. Changes will be posted on attaintoday.com, and continued use of our services implies acceptance of the updated Terms.

  1. Termination

We may terminate or suspend services for violations of these Terms, including non-payment or misconduct. Unpaid balances remain due even if services are terminated.

  1. Force Majeure

We are not liable for delays due to natural disasters, labor shortages, supply chain disruptions, or government restrictions. In such cases, we will notify clients promptly and work toward solutions.
